The 38th General Assembly of Nova Scotia represented Nova Scotia between June 25, 1925, through September 5, 1928. The first session of this assembly was convened on February 9, 1926. There were three sessions of the assembly during this period.

In the elections of 1925, represented a shift in company policy, which at the 37th General Assembly will mark the return of the conservatives to power after forty-three year absence.

One of the most important legislation to come out of this General Assembly, is the act of the abolition of the legislative Council and amending the Constitution of the province, in 1928. This law abolished the Legislative Council, the legislature of Nova Scotia, the legislators of the upper house. When Rhodes came to power in 1926, he had only one conservative member and 17 liberal members, with three vacancies, Rhodes, eventually, to appoint 15 new advisors in order to pack the Council by means of the abolition, rejecting all but a handful of liberal councillors.
